Privacy 4th or 1st?

Etzioni believes that privacy issues should be examined under the fourth amendment instead of the first amendment, and I agree with him. The only thing that kept the fourth amendment from being used as the bases of the privacy right is the case of Roe v. Wade, which was made into a privacy right that was more intuned with the first amendment. I feel like while some laws of fraud are being broken, most of the "good" American citizens still have their rights of privacy. The government is still protecting that right with the use of warrants and other documentation.
